Personal Injury
Personal Injury is a complex area of the law which has undergone significant legislative change in recent years. It is for this reason that you should engage a solicitor who has been certified by The Law Society of NSW as an Accredited Specialist in Personal Injury. Our principal, Gordon Jankov, is just such an accredited specialist and he will ensure that you receive up to date, expert advice so that you are aware of all your rights and entitlements, enabling you to make informed decisions.
Workers Compensation claims
If you have sustained an injury at work or the nature and conditions of your employment have caused you to suffer an injury, then you are entitled to make a claim for workers compensation benefits.
Our personal injury solicitor is an Approved Legal Services Provider with WIRO (Workers Compensation Independent Review Office) which means that we can apply to WIRO for funding of your workers compensation claim. If the grant is approved, which in the overwhelming majority of cases they are, then WIRO will pay for all of your legal costs and disbursements. All you have to think about then is your recovery and getting back to work.
Work Injury Damages claims
If you sustain an injury at work through the fault or negligence of your employer, then you may be entitled to make a work injury damages claim.
A work injury damages claim gives you an opportunity to claim for past & future economic loss (including superannuation).
Strict time limitations apply in relation to the making of work injury damages claims. We therefore recommend that you seek legal advice as soon as possible.
Motor Vehicle Accident claims
The system of making third party claims has undergone significant changes with the passing of the Motor Accident Injuries Act 2017. To ensure that the insurer provisionally accepts liability for your claim, an accident notification form must be submitted within 28 days of the accident. This initial process is important as it may entitle you to the immediate payment of medical expenses and reimbursement for wage loss. Please make an appointment with Capitol Legal solicitors in Liverpool as soon as possible so that we can advise and guide you through this process.

Family Law
The breakdown of a relationship can be a very stressful time, not just for the couple but for the entire family. At Capitol Legal family law Liverpool we offer you our extensive experience in resolving family law matters, both in and out of court, in an environment of sensitivity and confidentiality. It is an especially important time for you to be able to rely on comprehensive legal advice about your rights and entitlements.
We appreciate the emotional toll and financial impact that a relationship breakdown has on all the parties involved. For this reason, our priority is to quickly assess your legal position and provide you with realistic options and clear advice in order to facilitate a resolution through negotiation and mediation, which helps to avoid the expense of a final court hearing. However, if negotiation and mediation do not result in a satisfactory outcome for you then Capitol Legal will carefully prepare your matter for determination by the Court.
You should seek legal advice promptly as the law imposes strict time limits to apply for the division of matrimonial property after a divorce or the breakdown of a de-facto relationship.

Wills & Estates
Wills
Your Will is one of the most important legal documents you will ever have to sign. How long has it been since you last updated your Will? Does it reflect your current circumstances and wishes?
It’s important to draft a Will that makes your wishes and intentions clear for your loved ones, that is legally valid and binding, thereby minimising the risk of your Will being challenged. By doing this it helps to avoid confusion and conflict and also protects your family and friends from potentially costly and stressful legal disputes.
At Capitol Legal, your wills and estates lawyer can help you to ensure that your beneficiaries receive their intended shares.
Will Disputes
Have you been left out of a Will? Being left out of a Will can be a shock and extremely hurtful, especially at a time when you may still be grieving for your loss.
Do you wish to dispute a Will because adequate provision has not been made for you?
Under Family Provision legislation you may be entitled to challenge the Will and make a claim against the estate. There are time limits for making such claims so please contact Capitol Legal, will disputes Liverpool, to see if you would be eligible.
Probate
If you have been appointed as an executor of a Will, you may have to go through the process of making an application for Probate in the Supreme Court of NSW. If probate is granted by the Court, you will then have the authority to deal with the assets of the estate in accordance with the Will of the deceased.
If someone dies and they do not leave a Will then an application for Letters of Administration may need to be made with the Court.
Capitol Legal can assist you with either of the above processes to ensure that your loved one’s estate matters are handled efficiently and with care so that assets may be distributed as quickly as possible to beneficiaries.
Probate fees are regulated in accordance with the Legal Profession Uniform Law. Capitol Legal will only charge in accordance with those scaled fees for obtaining the Grant of Probate.
